INTELLECTUAL PROPERTY RIGHTS POLICY

Joyfultwig provides an internet-based platform that allows users to design and sell their own products and other merchandise. We contractually prohibit users from designing or selling merchandise that infringes upon the intellectual property rights of third parties, including but not limited to copyrights, trademarks, and related rights.

If you believe that a user of the Joyfultwig service has infringed your intellectual property rights, we encourage you to contact us using the procedure outlined below.

PROCEDURE FOR REPORTING INTELLECTUAL PROPERTY INFRINGEMENT

It is Joyfultwig’s policy to:

  1. Block access to or remove any content (including, without limitation, text, graphics, and photos) (collectively, “Content”) that we believe in good faith infringes the intellectual property rights of third parties after receiving a compliant notice; and

  2. Remove and discontinue service to repeat infringers.

If you believe that Content residing on or accessible through the Joyfultwig Service constitutes copyright infringement or otherwise violates your intellectual property rights, please submit a notice of infringement to the Designated Agent containing the following information:

  • Identification of the copyrighted work or other intellectual property you claim has been infringed, including registration number(s) if applicable;

  • Identification of the allegedly infringing Content, including:
    (a) a description of how the material uses the copyrighted work or other intellectual property in a manner that constitutes infringement; and
    (b) a description of where the material is located on the Joyfultwig Service with sufficient detail to allow us to verify its existence;

  • Your contact information, including full name, mailing address, telephone number, and email address;

  • A statement that you have a good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law;

  • A statement, made under penalty of perjury, that the information provided is accurate and that you are the rights holder or are authorized to act on behalf of the rights holder; and

  • An electronic or physical signature of the person authorized to act on behalf of the rights holder.

ONCE A PROPER BONA FIDE INFRINGEMENT NOTICE IS RECEIVED

It is Joyfultwig’s policy to:

  • Remove or disable access to the allegedly infringing Content;

  • Notify the member whose Content has been removed or disabled; and

  • Terminate access to the Service for repeat infringers and remove their infringing Content.

PROCEDURE TO SUBMIT A COUNTER-NOTICE

If the notified member believes that the removed or disabled Content is not infringing, or that they have the right to use such Content (including fair use), the member may submit a counter-notice to the Designated Agent containing the following information:

  • Identification of the Content that was removed or disabled, including a description of where it appeared on the Joyfultwig Service before removal or disabling;

  • A statement, made under penalty of perjury, that you have a good faith belief that the Content was removed or disabled as a result of mistake or misidentification;

  • Your contact information, including full name, mailing address, telephone number, and email address;

  • A statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if outside the United States, for the judicial district in which Joyfultwig is located, and that you will accept service of process from the party who submitted the original infringement notice;

  • Your electronic or physical signature.

If a counter-notice is received, Joyfultwig may provide a copy to the original complaining party, informing them that Joyfultwig may replace the removed Content or restore access to it within 10 business days. Unless the rights holder files a court action seeking an order against the member, the Content may be restored within 10–14 business days or more after receipt of the counter-notice, at Joyfultwig’s discretion.

LEGAL NOTICE

Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability for damages, including attorney’s fees.
